Middlesex County Bar Association Seminar

"S" Corporation Earnings and How they Effect Child Support
The Supreme Judicial Court of Massachusetts issued its decision in JS v. CC (SJC-10315) in September of this year. The payor of child support argued on appeal that the court erroneously included undistributed earnings of a closely held S Corporation in the calculation of his income for purposes of determining his child support obligation. The court indicated that such an inquiry must be made within the context of each individual case - "a case-specific, factual inquiry" - and outlined three minimum inquiries for the trial courts to make in making this determination.
